Definition of Cosmetics in Vietnam

Under Vietnamese law, cosmetics are defined as substances or preparations designed to be applied externally to parts of the human body—such as the skin, nails, hair, lips, or teeth—for the purposes of cleansing, caring, deodorizing, protecting, or enhancing appearance and overall condition. The cosmetics sector includes the following product categories:

  • Hair care products

  • Makeup products

  • Skincare products

  • Masks and lotions

  • Soaps and fragrances

  • Oral care products

  • Nail care products

  • Shaving products

  • Sunscreen products

It is important to note that products with medicinal, pharmacological, or immunological effects are not classified as cosmetics. These must be registered as pharmaceuticals and are subject to stricter regulatory controls.

 

Regulatory Background

As a member of the Association of Southeast Asian Nations (ASEAN), Vietnam follows the ASEAN Cosmetic Directive (ACD), implemented through Circular No. 06/2011/TT-BYT on Cosmetic Management, issued on January 25, 2011. Under these regulations, all cosmetics must undergo a notification process. Only after receiving a cosmetic notification receipt number from the competent authority can the applicant market and sell the products. The notifier is responsible for ensuring the safety, efficacy, and quality of their products.

 

Market Access Process

  1. Identify a Vietnamese responsible company

  2. Prepare notification documents

  3. Submit the notification

  4. Complete customs clearance for import

  5. Fulfill post-market obligations

 

Required Documentation

  • Business license of the Vietnamese company

  • Letter of Authorization (LOA) from the manufacturer or product owner

  • Certificate of Free Sale (CFS)

  • Scanned copies of inner and outer packaging labels

  • Product formula (using English INCI names and concentrations)

  • Digital signature token registered with the General Department of Customs

 

Notification Timeline

  • Processing time: 20–25 business days

  • Notification validity: 5 years

 

Product Information File (PIF)

The PIF consists of four main sections:

  1. Administrative documents

  2. Quality and safety data of cosmetic ingredients

  3. Product quality and safety information

  4. Safety and efficacy reports (e.g., safety assessments, test results, efficacy studies)

  5. Any other supporting documents
