Definition of Cosmetics in Thailand


According to Article 4 of the Cosmetics Act B.E. 2558 (2015) and Cosmetics Act (No.2), B.E. 2565 (2022), a cosmetic is defined as any substance or preparation intended to come into contact with external parts of the human body (epidermis, hair system, nails, lips, and external genital organs) or with the teeth and oral mucosa (through application, massage, rubbing, spraying, dropping, or any other method). Its sole or primary purpose is to cleanse, perfume, alter appearance, correct body odor, and/or protect or maintain the body in good condition. However, decorative items and clothing considered accessories are excluded.

Other items classified as cosmetics under ministerial regulations include: Cool towels/cool paper, Sanitary napkins/tampons, Oral spray deodorants, Alcohol-based hand sanitizers, Wet wipes.


Regulatory Background


The regulatory authority for cosmetics in Thailand is the Thai Food and Drug Administration (Thai FDA), which operates under the Ministry of Public Health (MOPH). The Minister of Public Health oversees the formulation and implementation of cosmetic regulations, standards, and measures.

To align with the ASEAN Cosmetic Directive (ACD), Thailand enacted the Cosmetics Act B.E. 2558 (2015) on September 9, 2015. This established a structured cosmetic filing system with a 3-year validity period, facilitating industry growth while emphasizing post-market surveillance as a regulatory priority.

Filing Timeline

  • Import License Application: 30 working days

  • Product Filing:

    • Low-risk products: 7–14 working days

    • High-risk products: 25–30 working days

  • Filing Validity Period: 3 years
