After received by The requesting instructions of implementing the transitional period of responsible person for cosmetic quality and safety in Jilin province ([2022] no. 1) published by Food and Drug Administration of Jilin Province and The requesting instructions of carry out the transitional period of responsible person’s working conditions for cosmetic quality and safety in Chongqing ([2021] no. 64) published by Food and Drug Administration of Chongqing. according to research, we hereby reply to the following questions:

1. According to the provisions Paragraph 2 of Article 32 of the Regulations on the supervision and Administration of Cosmetics, the person in charge of the quality and safety of cosmetics shall have the professional knowledge of the quality and safety of cosmetics and have more than 5 years of experience in the production or quality and safety management of cosmetics. Considering the urgent need of the current development of cosmetics industry, the identification of“Experience in cosmetics production or quality safety management”should conform to the reality of legislative intention and supervision. Considering that the principles of production or quality safety management of health-related products such as drugs, medical devices and special food are basically the same as those of cosmetics production or quality safety management. In the supervision practice, the person in charge of cosmetics quality safety should have the professional knowledge of cosmetics quality safety. Experience in the production or quality management of drugs, medical devices and special food can be regarded as the experience in the production or quality and safety management of cosmetics.

2. Pharmaceutical supervisory and administrative departments shall be responsible for cosmetics registrant, for the record within their respective administrative areas, entrusted production enterprise of quality and safety, strengthen the supervision and inspection and training guide, head of assessment whether the quality and safety of cosmetics have relevant professional knowledge and ability to sulk, supervise the quality of its products in accordance with the law to fulfill the corresponding safety management and product release responsibilities, ensure the quality and safety of product.
